1) Acceptance of Terms

These Terms & Conditions (“Terms”) govern your access to and use of PeptiFyLabs.com and any orders placed with PeptiFy Labs (“PeptiFy Labs,” “we,” “us”). By creating an account, accessing the site, or placing an order, you agree to these Terms and our Privacy Policy and Waiver/Indemnity (collectively, the “Agreements”). If you do not agree, do not use the site or purchase products.

2) Eligibility; Age & Qualification

You must be 21 years of age or older and represent that you are purchasing solely for lawful laboratory research conducted by qualified personnel in appropriate facilities. We may require proof of age, identity, affiliation, or qualifications, and we may refuse or cancel any order at our discretion.

3) Research Use Only; Restricted Uses

All products are sold strictly for laboratory research and development. Products are not: drugs, foods, dietary supplements, cosmetics, medical devices, APIs, or veterinary products. You must not use them in humans or animals or for clinical, diagnostic, therapeutic, or veterinary purposes, or for compounding or as active pharmaceutical ingredients (APIs). You are solely responsible for suitability, safe handling, storage, transport, and disposal in compliance with all laws and standards (including GHS/OSHA and any applicable institutional rules).

4) No Medical Advice; FDA Notice

Site content is for informational/educational purposes only and is not medical, pharmaceutical, or veterinary advice. Statements on this website have not been evaluated by the U.S. Food and Drug Administration. Products are not intended to diagnose, treat, cure, or prevent any disease.

5) Accounts; Order Acceptance

You are responsible for maintaining your account’s security and for all activities under it. Submitting an order is an offer to buy; we may accept or reject any order. We may limit quantities, verify information, or cancel orders (with a refund) for any reason, including compliance, fraud review, or availability.

6) Pricing; Taxes; Promotions; Errors

Prices, promotions, and availability may change without notice. We may cancel and refund any order affected by errors or inaccuracies. Unless we say otherwise in writing, prices exclude taxes, duties, and import fees, which you are responsible for.

7) Payments; ACH/E-Check; Chargebacks

By paying with ACH/e-check, you authorize a single electronic debit for the order total using the bank information you provide. Payments authorized after 11:00 PM Pacific Time are processed the next business day. Once authorized, no changes or corrections can be made. We may delay shipment pending payment verification and may refuse suspicious or fraudulent transactions. Unauthorized chargebacks may be disputed; repeated chargebacks may lead to account suspension.

8) Shipping; Risk of Loss; Temperature-Sensitive Items

Title and risk of loss transfer to you upon carrier hand-off. Inspect immediately on arrival. You must report loss/damage/defects within 48 hours of delivery with photos and order details. If you purchase “package insurance,” it typically covers carrier-confirmed loss or physical damage in transit and does not cover improper storage after delivery or unauthorized use. We are not liable for delays or failures caused by carriers, customs, or force majeure.

9) Returns & Refunds (Chemicals)

Due to the nature of research chemicals, returns are accepted only for unopened(sealed box/ intact seal sticker) items reported within 7 days of delivery and authorized in writing by us. We may require return for testing before credit. No returns for temperature-sensitive items after delivery, for items exposed to improper storage, or where prohibited by regulation. Shipping/handling are non-refundable unless required by law.

10) COAs; Specifications; Substitutions

Certificates of Analysis (COAs) are provided for identity/purity only and do not imply safety or efficacy for clinical/consumer use. Minor appearance variations can occur and are not non-conformities. We may ship a different lot meeting the same specification when necessary; COAs are batch-specific and may vary.

11) User Content; Reviews

You agree not to post or submit health claims or content that promotes human/animal use. We may moderate, remove, or refuse content at our discretion.

12) Intellectual Property

All content, trademarks, and other IP on the site are owned by or licensed to PeptiFy Labs. You may not copy, reproduce, distribute, or create derivative works without our prior written consent, except for limited personal, non-commercial use without removing proprietary notices.

13) Prohibited and Regulated Uses; Export Controls

You may not use the site or products in violation of any law, regulation, or sanction program. We may refuse, cancel, or delay orders if fulfillment would violate export controls, sanctions, or other applicable rules.

14) SMS Terms (If you opt into texts)

By providing your phone number, you consent to receive automated texts regarding promotions and order updates. Msg & data rates may apply. Msg freq varies. Reply STOP to cancel, HELP for help. Consent is not a condition of purchase. See our Privacy Policy for details.

15) Disclaimers

THE SITE, CONTENT, AND PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT HANDLING/STORAGE/USE WILL BE SAFE FOR ANY NON-RESEARCH PURPOSE.

16) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PEPTIFY LABS AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS/REVENUES/GOODWILL, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO A PRODUCT OR THESE TERMS IS LIMITED TO THE AMOUNT YOU PAID FOR THE AFFECTED PRODUCT OR US$100, WHICHEVER IS GREATER.

17) Indemnification

You agree to indemnify, defend, and hold harmless PeptiFy Labs and its owners, employees, and affiliates from claims, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from your (i) breach of these Terms or applicable law, (ii) purchase, handling, storage, transport, use, or resale of products contrary to these Terms or law, or (iii) posted content.

18) Governing Law; Arbitration; Class-Action Waiver

These Terms are governed by the laws of the State of Florida (without regard to conflicts rules). Mandatory arbitration: any dispute arising out of or relating to these Terms or the products shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules in Orange County, Florida. Either party may seek individualized relief in small-claims court or injunctive relief for IP misuse. Class actions are waived—all claims must be brought on an individual basis.
Opt-Out: You may opt out of arbitration within 30 days of first agreeing to these Terms by emailing info@peptifylabs.com with subject “Arbitration Opt-Out” and your name/order number.

19) Modifications

We may update these Terms at any time. Changes take effect when posted, and continued use constitutes acceptance. The “Last Updated” date appears at the top.

20) Severability; No Waiver

If any provision is unenforceable, the remainder remains in effect. Our failure to enforce any provision is not a waiver.

21) Force Majeure

We are not liable for delays or failures due to causes beyond our reasonable control (including carrier issues, customs, regulatory actions, natural events, or labor disputes).

22) Termination

We may suspend or terminate accounts or access for any breach or suspected misuse.
